Flow of trademark registration each country(Thailand)

Thailand has introduced one-application-multiple-division system. Therefore, you can combine the multiple divisions into one application.Thus, if a part of division is rejected, other division will be rejected even though that division does not have any problem. Therefore, pay attention how to write the application.

Flow of trademark registration

1.Submit an application form to Department of Intellectual Property (DIP)
2.Formal examination → if there is a defect Correction command (Correction shall be done within 60 days)
3. Substantive Examination → If there is reason for rejection, the reason for rejection will be notified to the applicant → the applicant may submit a written opinion within 60 days from the notice → Rejection → the applicant may appeal the rejection within 60 days from the rejection
4.Public Notice → the third party may object the trademark registration within 60 days from the public notice
5.Forwarding the notice of registration
6.Payment of registration fee
7.Completion of registration

Necessary documents

  • notarized Power of Attorney
  • sample of trademark

Summary

  • Term of trademark right…10 years from the date of application
  • Renewal … the trademark holder may renew trademark registration once every 10 year (shall apply renewal within 60 days from the expiration of the trademark registration)
